1. About This Privacy Policy

This Privacy Policy describes how Custom Caretaking & Landscaping, LLC ("CCTL," "we," "us," or "our") collects, uses, and shares personal information when you visit www.customcaretakingandlandscaping.com (the "Site"), contact us, request or receive our services (the "Services"), or apply to work with us.

By using the Site or the Services, you agree to this Privacy Policy. We may update this policy from time to time by posting a revised version with a new "Last Updated" date; if we make material changes to how we use previously collected personal information, we will provide notice before the change takes effect. Where applicable law provides greater protection than this policy, the law controls.

"Personal information" means information that identifies or can reasonably be linked to a specific person. It does not include anonymized or aggregated information.

2. Information We Collect

Depending on how you interact with us, we may collect:

  • Contact and identity information: name, mailing/service address, email address, phone number, and signature.
  • Property and service information: the location of the property we service (including its address and geographic coordinates), site measurements and conditions, gate codes or access instructions you provide, service history, estimates and proposals, equipment or features installed, and account balance.
  • Photographs and video of work areas: used for quality assurance, training, and documenting our work.
  • Communications: call recordings, voicemails, text messages, emails, and chat or web-form submissions, retained for quality assurance, training, scheduling, and record-keeping.
  • Payment information: payment card or bank details, which are processed by a third-party payment processor; we do not store full card numbers. We also keep billing history and, for certain commercial accounts, credit references.
  • Internet and device information: IP address, browser and device type, pages viewed, referring pages, and similar analytics data collected through cookies and similar technologies (Section 4).
  • Job applicant information: see Section 10.

We do not knowingly collect sensitive categories such as Social Security numbers, government ID numbers, health information, or biometric information from customers, and we ask that you not include them in messages to us.

3. How We Collect Information

  • Directly from you — when you call, email, text, submit a form on the Site, request an estimate, or speak with our team in person.
  • Automatically — through cookies and similar technologies when you use the Site (Section 4).
  • Through service documentation — job-site photographs and video as described in Section 2.
  • Call and message recording — we may record or monitor phone calls and retain text and email communications for quality assurance, training, and record-keeping. By communicating with us, you consent to our recording and retention of those communications.
  • From third parties — service providers such as scheduling/CRM, payment, mapping, and analytics providers; publicly available property records used to prepare estimates; and references or background-check providers for job applicants (Section 10).

4. Cookies and Analytics

The Site uses cookies and similar technologies to make the Site work, remember your preferences, and understand how the Site is used. You can control or delete cookies through your browser settings, although some Site features may not function without them. We do not track visitors over time and across third-party websites to provide targeted advertising, and the Site therefore does not respond to browser "Do Not Track" signals.

5. How We Use Personal Information

We use personal information to:

  • Prepare estimates and provide, schedule, and dispatch the Services;
  • Communicate with you about estimates, appointments, weather delays, and completed work;
  • Verify the quality and completeness of our crews' work, train our staff, and manage routes and scheduling;
  • Document site conditions and investigate damage claims or service disputes;
  • Bill for Services, process payments, and collect amounts owed;
  • Maintain the safety of our staff and your property;
  • Improve the Site and our Services, including through analytics;
  • Market our Services to you, subject to your opt-out rights (Section 11);
  • Detect and prevent fraud and security incidents; and
  • Comply with legal obligations, including tax, insurance, permitting, and record-keeping requirements.

6. How We Share Personal Information

We do not sell your personal information. Outside the corporate affiliates described below, we do not share it with third parties for their own marketing. We share personal information only with:

  • Service providers working on our behalf — such as scheduling/field-management software, payment processors, texting and phone platforms, website hosting, mapping and analytics providers, and accountants — who may use it only to provide services to us;
  • Corporate affiliates — businesses under common ownership with CCTL, which may use it for the purposes described in this policy and, subject to your marketing opt-out rights (Section 11), to tell you about their services by email or mail. Affiliates will not call or text you unless you separately opt in to communications from that brand;
  • Subcontractors and suppliers where needed to perform your project (for example, a materials delivery to your address);
  • Professional advisors, insurers, and collection agencies where necessary to resolve claims or collect amounts owed;
  • Government authorities and law enforcement when required by law, subpoena, or court order, or when we believe in good faith that disclosure is necessary to protect safety, property, or legal rights; and
  • A successor entity in connection with a merger, acquisition, financing, or sale of assets, in which case this policy will continue to apply to previously collected information unless you are notified otherwise.

Text messaging: text messaging originator opt-in data and consent will not be shared with or sold to any third party for marketing purposes, excluding the platform providers that send messages on our behalf.

7. Text Message (SMS) Terms

If you opt in to text messages from CCTL, we may send you messages about estimates, scheduling, service reminders, and — only if you separately agree — promotions. Message frequency varies. Message and data rates may apply. Reply STOP to cancel at any time and HELP for help, or contact us at (715) 356-6961. Consent to marketing texts is not a condition of purchasing Services. We are not liable for delayed or undelivered messages.

8. Security and Retention

We use commercially reasonable administrative, technical, and physical safeguards to protect personal information, including access controls and encryption where appropriate. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

We keep personal information only for the amount of time reasonably necessary to fulfill the purposes described in this policy, unless the law permits or requires us to retain it for a longer period.

9. Children's Privacy

The Site and Services are not directed to children under 16, and we do not knowingly collect personal information from them. If you believe a child has provided us personal information, contact us and we will delete it.

10. Job Applicants

If you apply to work at CCTL (including through the career application form on the Site), we collect the information you provide — such as contact details, work history, education, references, and driver's license information where the role involves driving — and, with the notices and authorizations required by law, background check and driving-record information from consumer reporting agencies. We use applicant information to evaluate your application, verify eligibility to work, communicate with you, and comply with legal obligations. Applicant information is shared only with our service providers (such as background check and payroll providers) and as required by law. If you are hired, applicable employee policies will describe workplace data practices, including GPS tracking of company vehicles and equipment.

11. Your Choices and Rights

  • Marketing opt-out: unsubscribe links in our emails, reply STOP to texts, or contact us to be removed from marketing lists. We will still send transactional messages about your Services.
  • Privacy questions and requests: contact us using the details in Section 12 with any question or request regarding your personal information; we will verify your identity where appropriate and respond as applicable law requires.
  • State privacy rights: if you reside in a state whose privacy law applies to us and to you (such as California, Colorado, Virginia, or Texas), you may have additional rights — including access, correction, deletion, portability, and opting out of targeted advertising, sale, or profiling — and the right to appeal a refusal. You may exercise those rights, or submit an appeal, using the contact details in Section 12.
